US DOT Number Application

Companies that operate commercial vehicles transporting passengers or hauling cargo in interstate commerce must be registered with the FMCSA and must have a USDOT Number. Also, commercial intrastate hazardous materials carriers who haul quantities requiring a safety permit must register for a USDOT Number.

The USDOT Number serves as a unique identifier when collecting and monitoring a company’s safety information acquired during audits, compliance reviews, crash investigations, and inspections.

Motor Carrier Interstate Authority

FMCSA operating authority is often identified as an “MC,” “FF,” or “MX” number, depending on the type of authority that is granted. Unlike the USDOT Number application process, a company may need to obtain multiple operating authorities to support its planned business operations. Motor Carrier Intrastate Authority

Intrastate commerce is trade, traffic, or transportation within a single State. If your operations include interstate commerce, you must comply with the applicable Federal safety regulations and Operating Authority rules, in addition to State and local requirements. You must notify the State in which you plan to register your vehicle(s) of your intentions to operate in interstate commerce to ensure that the vehicle is properly registered for purposes of the International Registration Plan (IRP), and International Fuel Tax Agreement (IFTA).

If you operate exclusively in intrastate commerce, you must comply with applicable State and local regulations. The only Federal regulations that are applicable to intrastate operations are: the commercial driver’s license (CDL) requirement, for drivers operating commercial motor vehicles as defined in 49 CFR 383.5; controlled substances and alcohol testing for all persons required to possess a CDL; and minimum levels of financial responsibility for the intrastate transportation of certain quantities of hazardous materials and substances.

IRP and IFTA Application

International Registration Plan (IRP)
IRP is the acronym for the International Registration Plan. The IRP is a special plan for registering vehicles that must travel in two or more member jurisdictions.

The IRP is specific in requiring all member jurisdictions to comply with the following three basic principles:

  • A single registration plate
  • A single registration card (cab card)
  • Allowing registrants to perform both interstate and intrastate vehicle movements

IRP is required when a vehicle(s) travels in two or more jurisdictions (State or Canadian Province) and is:

  • A power unit having two axles and a gross weight in excess of 26,000 pounds or more; or
  • A power unit having three or more axles regardless of weight; or
  • A power unit that is used to pull another unit and the combined weight exceeds 26,000 lbs

International Fuel Tax Agreement (IFTA)
IFTA is the acronym for the International Fuel Tax Agreement. All interstate and inter-jurisdictional carriers that travel in IFTA member jurisdictions with a qualified motor vehicle must file fuel taxes through the International Fuel Tax Agreement (IFTA). IFTA member jurisdictions include all contiguous states (except Alaska and the District of Columbia) and Canadian provinces (except Northwest Territories, Nunavut, and the Yukon Territory)

A “qualified motor vehicle” means a motor vehicle used, designed, or maintained for the transportation of persons or property and:

  • Has two axles and a gross vehicle weight or registered weight exceeding 26,000 pounds or 11,797 kilograms;
  • Has three or more axles regardless of weight;
  • Used in combination when the weight of such combination exceeds 26,000 pounds or 11,797 kilograms gross vehicle weight, or registered gross vehicle weight.
  • Qualified motor vehicle does not include recreational vehicles and vehicles owned by the U.S. Government.

According to www.IFTACH.org, the process by which one comes to both apply and comply with IFTA is as follows:

(1) Carrier submits license application to base jurisdiction

(2) Base jurisdiction reviews and processes license application of qualified candidate

(3) Base jurisdiction issues one IFTA license to each carrier and one IFTA sticker for each
qualified motor vehicle operated

(4) Licensee operates and prepares an IFTA Quarterly Fuel Tax Report with base jurisdiction

(5) Licensee files the IFTA Quarterly Fuel Tax Report with base jurisdiction and remits any IFTA
tax due

(6) Base jurisdiction reviews and processes the tax return and remittance

(7) Base jurisdiction processes all other IFTA tax returns received

(8) At the end of each filing month, base jurisdiction sends transmittal reports to all other
member jurisdictions

(9) Base jurisdiction sends refunds to licensees and issues assessments for any taxes due
